Failure to Supervise at the Federal Trade Commission
Many MLM sales people mean well but they inadvertently commit fraud and violate rules and laws in their presentations. This is unfortunate and is an issue too big for the Federal Trade Commission to handle, like SPAM or Identity Theft; the FTC is impotent. Many of these MLM sales people have adopted the term; "Private Franchising" trying to distance themselves from the negative connotations of the multi-level marketing term. There is only one problem; Franchising, has an absolute definitions, which in no way resembles what these salespeople are out peddling. If the MLM sales people do not understand the laws and the consumers do not understand the definitions of a franchise; after all they cannot find the states on a map of the US; it appears that there is nothing that can be done? Does this mean that the costs to educate the general public are too high and that money would be better spent hiring more attorneys at the Federal Trade Commission to attack and collect fees against small and medium sized companies which provide more jobs, tax base as a whole than the larger companies who pay little if any taxes or the small tiny MLM companies which provide one or less jobs? Many see a whole lot of double standards here and question the true motivation of the Federal Trade Commission law enforcement efforts, which is quickly becoming the redheaded stepchild of the Department of Justice. We all need clarification. Many think the business community has that right to clarification and the Federal Trade Commission has the responsibility to tell the country why it allows massive fraud on one hand, yet will modify complaints, declarations and use secret courts as tactics to selectively prosecute much more reputable businesses? If the Federal Trade Commission cannot answer this question, then the franchising and business op division, no matter what verdict is reached on the newest revisions of definitions of these business models, should be shut down. This would help the taxpayers who should be alleviated from the cost of burden of their endeavors. Shutting it down would be smart as in the franchising industry there is no fraud to speak of and in the business opportunity division because it is not being enforced anyway. Simply admit, that business opportunity virus has reached epic proportions like SPAM and the problems cannot be controlled. Let another agency take over such as the CDC. Think about it. Justice Department Losing the War on Street Gangs The Justice Department is at it again; promoting themselves in the mass media attempting to convince us we are safe. This time they are grandstanding a few arrests of alleged gang members. MS-13 is recruiting over 300 people per week in cities across the United States. Recently the Justice Department held a huge press conference, claiming that in a two-week period they arrested 582 people. Now then if the MS-13 gang is recruiting 300 people per week and the caught 582 in two-weeks then they are 18 gang members in the rear for that two-week period alone. Most of the offenders, gang members were said to be picked up between July 16 and July 28, other arrests followed after search and seizures of evidence was taken. Recently the FTC, Federal Trade Commission put forth a report on franchising. They want to further add to the franchise rule, even though they should be reducing regulation since there is not fraud to speak of. In our country we have identity theft and identity creation costing this country billions of dollars and destroying family credit, chances to own a home and allow them to join the ownership society. We have SPAM costs businesses some 30-57 estimated billions of dollars per year in lost productivity. In the last 24 hours I have received 2336 emails and only 120 were legitimate, the rest was SPAM. As far as Law Enforcement experience at the Federal Trade Commission, I think there is work that needs to be done and I would not call what has been done in franchising regulation enforcement; law enforcement experience. You can call it grandstanding with fancy meetings, press releases, PR events, case filings, but the fact is that the Federal Trade Commission has failed. The FTC failed. My SPAM has gone up 3000% since up started enforcing it? Identity theft has run ramped. On October 28, the FTC announced at a meeting of private investigators that they had filed now 63 cases against SPAM. Guess what it is not working, my SPAM is still increasing? So if filing lawsuits is considered a law enforcement experience, it is not any problems. Similarly the FTC's failure to bring relevant and honest cases against disreputable franchisors show one of two things, either; Open Source and Post-Capitalistic Society Capitalism as the social structure was founded in order to support further evolution and development of human race, to support the innovation which was oppressed by the former system.
