Biz Op Marketing and the Federal Trade Commission
Many had made mention of the problems of business opportunities in letters to the Federal Trade Commission in the public hearings in 1995, 1997 and 1999. They cited issues with advertising and earnings claims from Biz Op sales people. The FTC launched a sting operations called; "Operation Bizzillions," which stopped a few hundred such operators out of the 80,000 such business opportunities. This action by the FTC did collect some fines for the Federal Trade Commission in their quest to show progress here, but the MLM virus has again evolved and found a new host since the comments of 1999 and needs to be addressed in this rule making comment period and a vaccine needs to be introduced. The reputation of the franchising community in the market place has been hard fought and the viruses of business opportunities have been able to re-align themselves with that success. The Federal Trade Commission needs to separate out the two. Franchising and Franchise needs a pure legal definition that cannot so easily be used to promote that which barely resembles anything close to it, by fast, high decibel talking salesmen coaxing middle class Americans into a ponzi scheme using the franchising definition and examples. For when this is done it is lying to consumers in a harmful and hurtful way under the auspices of the business format I love. This my friends is unacceptable and must be stopped; a difficult task for Federal Trade Commission law enforcement? Yes, perhaps this is the reason that no mention was made of it anywhere in the recent FTC reports on this issue? Many MLM sales people are now using the term "Private Franchising" to uplift their status from Multi-Level business to that of the established franchise community. Losers because anyone in the market place who was winning does not have time to show up, they are too busy producing and participating in their respective industries. So they hire attorneys to show up and talk with regulators. Those attorneys who have no real clients of any value also show up because they know be getting in bed with the regulators and bending over a little, they can get the occasional reach around in the process and a little juice. This can help them get good corporate clients and make big bucks. All these scoundrel, I mean attorneys have to do is promise the regulators jobs when they get sick of the bureaucracy. How Many Cases Will Elliot Spitzer Lose Now? The devastating loss in case of Elliot Spitzer for NY Governator VS. Bank of America has set back the mirage behind the man who would be king. His case has clothes and his paper work no validity. This was one of the first of his high profile cases to run its course in the New York Court system. Apparently the house of cards like a bunch of watered down cattle is now public. The ponzi governor is now cut short. If only the election could have been two-weeks ago he might have fooled everyone that his entire career was not built on false premise. Truckers are complaining and the average American is modifying their travels, errands and schedules around to deal with the fuel cost increases. Wholesale inflation looms as all the costs for shipping are being passed on. Even though people are joking about the outrageous costs of fuel, it is a serious matter. Hybrid sales are up over 50% in the last two-months and dealers cannot keep them stocked. But what about other fuel costs. Gasoline, diesel and jet fuel are not the only fuel costs up these days. The average cost of such audits in Maryland due to all the Maryland lawyers suing is about $40,000. Let me tell you where I differ, first off, a mobile business franchise is a safe investment even if property rights are not yet established. It can service the connected elite. This is great. By promoting free market system and selling of wares in the street and mobile businesses a countries early beginnings are possible of establishing a small economic base. I know this is feasible from first hand knowledge.
