Emerging Markets, Property Law
I read an interesting article in foreign Affairs magazine last year, and recently in the Economist also. The articles stated in some way that a country without a set of laws for property rights would mean slow-growth, lack of foreign investment and economic vitality would be scarce. While I tend to agree with this premise to some degree, I think you might enjoy a second opinion. Let me tell you where I differ, first off, a mobile business franchise is a safe investment even if property rights are not yet established. It can service the connected elite. This is great. By promoting free market system and selling of wares in the street and mobile businesses a countries early beginnings are possible of establishing a small economic base. I know this is feasible from first hand knowledge. So what does this mean; it means a company like I own; The Car Wash Guys; should be first in, last out. Yes, that term was stolen from an accepted accounting principle for measuring inventory. Just a thought for all you who question the revival of Amsterdam Academic Economic Models in emerging markets and see the first step as one which should bind the country in premature laws which might be culturally incorrect for nations of 1000 years of no property laws at all. This idea of small mobile type businesses, open market displays of wares and food on carts or mobile services make sense as the first step. Think of countries today on the African Continent and elsewhere in which the land is owned by an invisible God of their cultural choosing which has been known to them for thousands of years? Think past the norms of immediate laws and work towards the exchange of trade and stability in confidence of the people who live in the cities, towns and villages, before we thrust our laws and lawyers on those folks. No sense in over regulating or over-lawyering an emerging market with a layer of bureaucracy when you are trying to accelerate the entrepreneurism and free market fundamentals. America Needs Election Reform to Ensure Congressional Honesty America must implement a policy on Election Reform that is equitable and fair to everyone. It is something we must do if we are to be a progressive society, a society for everyone, rich or poor. PA Congressional Pay Hike Raises Eyebrows While many Pennsylvanians are struggling to figure out how they can pay their real estate taxes before the end-of-the-year deadline, the PA congress not only votes an extra $11,403 onto their base pay, but those on committee chairs receive an additional $4,050. Speaking in terms of percentage, the pay hikes ranged from 16% - 34%, while most of their constituents are lucky to see a 3% raise. At least the past congressional bodies, in their wisdom, made a congressman's pay increase not take affect until the following election term. But like any enterprising citizen would attempt, lawmakers looked for---and found---loopholes in the law that allows them to take "unvouchered expenses" and thus have access to the piles of tax dollars being shoveled into their waiting accounts. Cracking Down on Cigar Counterfeiters In the most rewarding new industries, there is often a convergence of factors that make them lucrative and sustainable. Factors like the emergence of new technologies, a ripening of the consumer market, or a political climate that spawns laws and regulations that give a particular business model oomph can revolutionize an industry. Over the last two decades, the counterfeit cigar industry in the United States saw all three of these factors converge to create the perfect storm of the illicit trades market. It began in the 1960's as the trade of authentic Cuban cigars was banned in the United States. This immediately created a situation in which there was a consumer demand for a product that was all but inaccessible through conventional retail channels. More recently, the explosion of computer and printing technology has allowed for the easy duplication of cigar boxes, labels and seals of authenticity. Finally, the growing popularity of cigars over the last fifteen years has fueled a consumer market that is eager to get its hands on any kind of Cuban cigar possible. In this environment, producing counterfeit cigars is all but the perfect business move. Add to this fact that the punishment in the U.S. for this type of counterfeiting is among the most minimal for illicit, black-market crimes, and the reward seems well worth the risk. Altadis, USA has consistently been a prime target for counterfeiters with the reputation of its ubiquitous cigar lines. Montecristo, Romeo y Julieta, and H. Upmann are all among the most notoriously spoofed cigar lines in the United States, and Altadis is beginning a major crackdown. On March 25th, 2005, Altadis, USA was awarded $3.5 million in counterfeiting and trademark infringement against two Florida corporations. The corporations have now been disbanded. In addition to the damages, the counterfeiters were ordered to recall their entire product line including promotional and packaging material and deliver it to Altadis for destruction. The participants in the two corporations are also permanently enjoined from employing graphics that are confusingly similar to trademarks within the Altadis cigar line. The cigar boom of the late 1990's brought with it two major problems - the first was the proliferation of sub-par cigar lines and the second was the increased circulation of counterfeit cigars. Sub-par cigars have, for the most part, been filtered-out with the rapid decline in consumption that occurred between 1997 and 2001. Companies that did not have a strong foundation in quality were forced out of business. Now, it looks like, major corporations are finally stepping up to weed-out the proliferation of counterfeit cigars. In the 2005 United States cigar market, you would be hard-pressed to find someone who would disagree with the fact that there are more higher-quality handmade cigars available at better prices than ever before. To ultimately do serious damage to the counterfeit cigar industry, it will take the efforts of Altadis redoubled and spread all over the globe. But now that the counterfeiters are being taken to task, maybe we can all have the confidence that we get what we pay for. North Korea and Diplomatic Solutions; Random Thoughts Part III Sizing up North Korea is important for a war there. We must leave all options on the table and of course give the Chairman of North Korea the respect he wishes while remaining firm as Hell until it freezes over in fact if that's what it takes; I now conclude my random thoughts over the last few years on North Korea and Diplomatic Solutions. Take Marijuana Off the DEAs Docket Quit paying the DEA to chase marijuana. We could save millions for education (or tax credits, for you republicans). We spend millions locking up Americans for using marijuana. Or as NORML says in a 1999 billboard campaign up in bus shelters around the city, "A Pot Smoker is Busted Every 45 Seconds -- and You Wonder Why We're Paranoid." Predator or Prey; Hunter or the Hunted; Teacher or the Pupil; Winning or Losing? This is a thought on the study of Home and Away Games, The Best Team Always Has the Advantage. Predators and Prey; The Hunters and The Hunted. Recently Rumsfeld asked his brightest commanders to come up with strategies to combat Islamic Extremists Terrorists. Here is an idea. Set up a couple of Humvees, which would drive at normal speed a head of a van, which had interior 1" steel walls. Drive the Humvees in front and use remote control to draw fire. Put mannequins in the Humvees. And a Big America flag to piss them off. The van will have SWAT Team Special Forces. When the humvees are shot at stop them and the van unloads and surrounds the area from the rear and special forces shoot each one between the eyes, cut off the heads stick them on the posts out front of the houses where they were found and just get back into the van and drive around again. This would be no problem with modern technology. We know in the future this will be an accepted method and fully safe. Politicians Are Like Car Sales People Well, another election has come and gone in the US and no matter which way you voted there are some important marketing lessons to learn. The World of Diplomatic Backstage De-classification of official documents have been a routine practice in the United States, while just the opposite is true of Pakistan. Successive governments over the years have believed in hiding away from public eye even the most innocuous of official documents without realizing that the practice only adds to the sense of national confusion. "I will expose everybody when the time is right," is a sentence that finds place in every politician's armory. A case in point is that of Mohammad Khan Junejo who kept repeating the line in the context of the Ojhri disaster, but the "right time" never came in his own lifetime. US Government Owes Martha Stewart 1 Billion Dollars The prosecutors in the Martha Stewart Case used testimony from an FBI agent who lied under oath to secure a conviction. The prosecutors knowingly and willfully allowed the FBI agent to tell a lie while he was a witness in the courtroom. This is fascinating indeed as they could not convict Martha Stewart for insider trading, so instead tried to get her on a lying technicality to the investigators. So in essence the government lied to convict a Billionaire Tax Paying employer who built her business on blood sweat and tears from scratch on a charge of lying. How can we as Americans actually ever believe in Justice in this country when we cannot even trust our own government to tell the truth? In other words does "Truth, Justice and the American Way" still exist in America? Did it ever? Does the government always lie under oath? Bureaucracy Suffocating the Flow of Transportation We are slowing the transportation flows of our civilization by over burdening our transit systems, transportation companies, airlines, railroads and shipping companies with linear thought out rules and regulations. We are over regulating, over taxing and attacking the free market sector companies and this is cost America jobs, governments in tax base and hardship for travelers, vendors and industry, which rely on this transportation.
