Maryland Lawyers and Politicians Want More Regulations
We know that in Maryland, which some call "Merry Land" due to its completely liberal skew that Sarbaines Oxley laws were born. These laws no matter what anyone will tell you, have done more to upset our trade deficits with China than any other single factor. Senator Sarbaines is not even running for re-election now, which is smart because he would have major opposition and who ever was close to beating him would have on hell of a bank roll to do it. It is hard to say really which is worse; Osama Bin Laden hiding in a Cave or Senator Sarbaines who lives in a box (opinion). Last year a Maryland legislator decided we need more regulations on franchise companies in their state? I respectfully disagree with any additional franchise legislation. There is already too much and it is choking America's economic system. 2/3 of every consumer dollar goes through a franchise, 10% of all people are employed in small business, of those the most successful are franchised. Putting up barriers to entry, increased cost as we move out of a recession will further destroy your tax base and growth. It is anti-small business because large franchisors can absorb such additional costs and smaller start-up entrepreneurial franchise systems cannot. Just recently a lady from a church in Maryland called us and asked for a gift certificate for a silent auction. The church was raising money to fix up houses for people without means after the winter storms, a noble cause indeed. We could not help her or give her a gift certificate because we are not franchising in Maryland and do not have franchisees presently in that state. Why are we not providing jobs and franchising in Maryland? Those people with no means might have means if they had a job, right? Your state would have a larger tax base with more jobs, right? With a larger state budget from a larger tax base, Maryland legislators as leaders could do more to help humanity right? Isn't that why they joined in the game, to do what is right? Hmmm? Of course it is. But we do not franchise in Maryland, because it is hostile with over burdensome current franchise registration laws and want to add more? The two worst franchise registration states are CA and Maryland, interesting they also have the most lawyers. The bill does not help consumers. That is a farce and falsehood at best. Example, the consumers in this true story above. The consumers who go to that church who would like a little help from a franchisor and their franchisee, which normally would be no problem if we did business there in your state. The people with no means who have lost their jobs; they consumers too. Yet they consume very little without a job or money as a matter of fact with their houses and domiciles in disrepair they are lucky to have not frozen to death or starved this winter. Cracking Down on Cigar Counterfeiters In the most rewarding new industries, there is often a convergence of factors that make them lucrative and sustainable. Factors like the emergence of new technologies, a ripening of the consumer market, or a political climate that spawns laws and regulations that give a particular business model oomph can revolutionize an industry. Over the last two decades, the counterfeit cigar industry in the United States saw all three of these factors converge to create the perfect storm of the illicit trades market. It began in the 1960's as the trade of authentic Cuban cigars was banned in the United States. This immediately created a situation in which there was a consumer demand for a product that was all but inaccessible through conventional retail channels. More recently, the explosion of computer and printing technology has allowed for the easy duplication of cigar boxes, labels and seals of authenticity. Finally, the growing popularity of cigars over the last fifteen years has fueled a consumer market that is eager to get its hands on any kind of Cuban cigar possible. In this environment, producing counterfeit cigars is all but the perfect business move. Add to this fact that the punishment in the U.S. for this type of counterfeiting is among the most minimal for illicit, black-market crimes, and the reward seems well worth the risk. Altadis, USA has consistently been a prime target for counterfeiters with the reputation of its ubiquitous cigar lines. Montecristo, Romeo y Julieta, and H. Upmann are all among the most notoriously spoofed cigar lines in the United States, and Altadis is beginning a major crackdown. On March 25th, 2005, Altadis, USA was awarded $3.5 million in counterfeiting and trademark infringement against two Florida corporations. The corporations have now been disbanded. In addition to the damages, the counterfeiters were ordered to recall their entire product line including promotional and packaging material and deliver it to Altadis for destruction. The participants in the two corporations are also permanently enjoined from employing graphics that are confusingly similar to trademarks within the Altadis cigar line. The cigar boom of the late 1990's brought with it two major problems - the first was the proliferation of sub-par cigar lines and the second was the increased circulation of counterfeit cigars. Sub-par cigars have, for the most part, been filtered-out with the rapid decline in consumption that occurred between 1997 and 2001. Companies that did not have a strong foundation in quality were forced out of business. Now, it looks like, major corporations are finally stepping up to weed-out the proliferation of counterfeit cigars. In the 2005 United States cigar market, you would be hard-pressed to find someone who would disagree with the fact that there are more higher-quality handmade cigars available at better prices than ever before. To ultimately do serious damage to the counterfeit cigar industry, it will take the efforts of Altadis redoubled and spread all over the globe. But now that the counterfeiters are being taken to task, maybe we can all have the confidence that we get what we pay for. The phrase carried a lot of baggage, especially with conservatives who had long heard the term associated with a one-world government with little room for individual rights. Some believe the first George Bush's attachment to this term hurt his chances for re-election, and contributed to the movement that brought Ross Perot into the fray and split the conservative vote. Richard Nixon, the truth Richard Nixon was by far a most fascinating and colorful character in our nations history. Richard Nixon, well even his dog's past was checkered. Richard Nixon was an excellent diplomat, negotiator and politician. Anyone who studies Machiavelli, Carl von Clauswitz, Politics and the reality of the human species has to understand what really goes on. Without praise or condemnation Richard Nixon was a man who indeed, did care very much for this country and served our nation very well in many regards. His foreign diplomacy and tough negotiations came in handy at a time when those skills were needed. And yes there was the other side of history as well. I recommend an Audio Book, which has many excerpts of his secret tapes on them to better understand the man; Iranian Elections - Roadmap To Continued Apathy The recent first round of the Iranian elections somewhat resembled the rise to power of the promising Mohammed Khatami first time round in 1999. But despite the break from apathy seen over recent elections, the liveliness does not bode anywhere near the same promise that Khatami managed to swirl up six years ago. There's been discouraging controversy and intrigue surrounding the running of the main reformist candidate Mostafa Moin and the last minute participation of Hashemi Rafsanjani also brought zest to the process. Rafsanjani is tipped to win however simply because most people believe he holds the most sway over the country's real ruler, the supreme Ayatollah Ali Khameini, who shows no signs of letting go of his power.
